Court backs Sony over 2010 tender dispute 09/09/2008

The Johannesburg High Court yesterday dismissed an application by Digital Horizons (DH) to have the R380m tender awarded to Sony SA by the SABC set aside.
DH had claimed the tender process was flawed and tainted with irregularities. Sony said the contract was based on the resources that it can utilise to deliver a project of this magnitude.
The deal was concluded last month, despite the legal application. The court ruled that delaying the tender could affect the SABC’s ability to broadcast matches during the Confederations Cup and the 2010 World Cup.
Judge Frans Malan said failure by the SABC to comply with its commitments to FIFA would be embarrasing. ’It would, moreover, not serve the public good if the interim relief were given.’
